A Phoenix woman is behind bars, accused of killing her boyfriend while they were sharing a motel room together.
Police say 25-year-old Gabriella Marie Dolores Orona Hardee says she was straddling her boyfriend on motel room bed when she grabbed an AK-47 rifle.
"I sure hope it was an accident because it's a shame if someone got shot for no reason," said Roy Ross, a customer at the same motel.
Roy Ross was staying at the motel Thursday night when the shooting happened. He said a maid heard the gunfire.
"One of the maids came by and said 'oh I was next door and heard the shooting'. She was shaking and everything. Usually nothing ever happens here."
According to the police, Hardee told them she was straddling her boyfriend when she decided to grab the loaded rifle which was next to them. She admits to pointing the rifle at her boyfriend's head and putting her finger on the trigger.
But she says she didn't intend to fire the rifle.
In the end, her boyfriend was shot and killed and she is now in jail for negligent homicide.
But a Maricopa County Judge believes the killing was more than negligent. The county prosecutor believes she should face a more serious homicide charge such as murder in this case.
The prosecutor had asked for a $250,000 bond, but the judge set the bond at $100,000.
