Parents arrested after unexplained death of 5-month-old son

Police are investigating a suspicious infant death at an apartment complex near 33rd Avenue and Thunderbird that happened Tuesday night.

- Police are investigating a suspicious death involving an infant at an apartment complex near 33rd Avenue and Thunderbird that happened Tuesday night.

When officers arrived at the scene, they found the 5-month-old baby not breathing.  The child, identified as Will-Lae Chamarrrae Porter, was taken to an area hospital where he was later pronounced dead.

According to the Department of Child Safety, the office has had prior history with child's parents, 23-year-old Joseph Daniel Porter and 27-year-old Willana Tae Rostchild.

Will-Lae was placed in a foster home in May, became a ward of the court in June and in September, the court ordered a change of physical custody. He was placed with someone else and according to DCS, without their knowledge or consent of the court, Will-Lae was returned to his parents.

"The death of any child is heartbreaking, the death of a child in our legal care is even more painful," said DCS Director Greg McKay. "DCS protected this baby. We are angered and saddened that someone entrusted to his care placed him back in harm's way against all orders."

"During interviews with police, both parents admitted to being aware of the order and being in violation by having unsupervised control of the baby in the days preceding his death," stated Sgt. Jonathan Howard of the Phoenix Police.

Porter and Rostchild were booked for one count each of Custodial Interference, a class 6 felony.
