PHOENIX (KSAZ) - A Gilbert man is facing child abuse charges, after police claims he covered the mouth of his girlfriend's young son with a hand and a pillow, trying to quiet him down.
Reportedly, it was what the boy's older brother did next that led to the man's arrest.
According to court paperwork, Joseph Michael Garcia, who lives with his girlfriend and her children at a Gilbert home, placed a Ninja Turtles pillow over the face of a five-year-old boy. Paperwork says it was punishment for the little boy not wanting to sleep in his own room.
Court records go on to say that the little boy's older brother actually recorded a 26-second video of the incident, where the five-year-old can be heard screaming and yelling that couldn't breathe. The paperwork also says that the mother of the children was at home at the time of the incident.
According to Gilbert Police, Garcia is the only one facing charges at this time.
