Loved ones share grief with judge in sentencing phase for man who killed roommate back in 2016

- In Superior Court, anguished cries came from the family of a murder victim Friday.

In 2016, Zachary Penton  tweeted he'd "viciously murder" his roommate, Daniel Garofalo. Garofalo would later be shot in the back and in the abdomen, killing him.

Friday was originally supposed to be sentencing day for Penton, but there was a delay, as the defense needed more time to argue against an aggravated manslaughter sentence for Penton. The judge, however, let Garofalo's family members express their pain and grief, and how his loved ones will never recover.

Penton avoided eye contact with Garofalo's family, as they came forward, one-by-one.

"Zachary Penton's decision to take life of human, no regard for effects on others, is unimaginable," said Daniel's father, Dennis. "No more birthday celebrations, holidays and family activities without him. Laughter, hugs, guidance and advice."

"There was a side of Danny that was so funny, so wonderful," said Daniel's mother, Barbara. "He would make people laugh, made him happy. He would help anyone. That is Danny. I cannot explain. I wish people knew him. The hole that is left can never be filled." 

One of Daniel's brother, Dennis Jr., read a letter written by Daniel's son, Anthony.

"Now my dad is going to miss every birthday and holiday," said Dennis Jr. "We had so much fun I looked forward to it. Can never do that again. It is all about the choices Zach Penton made."

"It has been a year and a half since our brother was taken from us by an evil monster named Zach Penton," said Daniel's brother, David. "They say time heals all wounds, but neither time nor the prison sentence will bring back my brother."

Penton is scheduled to be back in court on April 27, and could be sentenced at that time.
