Phoenix Police: Woman seriously injured after shooting

Police say a woman was shot in her home while three children were inside.

This happened near 75th Avenue and Buckeye just before 1:00 a.m. on Friday.

Authorities say witnesses reportedly heard an argument in the home prior to the suspect calling 9-1-1 to report the shooting.

Phoenix Police say 41-year-old Miguel Nieves shot his 29-year-old girlfriend while she was holding her child.

The woman was transported to an area hospital and remains in serious condition. The children were not injured and have been turned over to CPS custody.

Neighbors told FOX 10 they heard the two fighting before shots were fired.

"You can just hear them going back and forth and you can hear a loud thud.. she lost her breath.. you can hear her gasping and it went silent," said Xavier Hernandez, a neighbor.

Neighbors in the area added that the suspect called 911 after the shooting and told them he shot someone he thought was breaking into his house.

Detectives say the victim is not cooperating with detectives. Nieves has been charged with one count of aggravated assault, endangerment, and discharging a firearm in the city limits.
