Man fails to retain dismissal of criminal charges

ST. JOHNS, Ariz. (AP) - A man who had charges against him dropped in the deaths of 2 eastern Arizona men but later had the dismissal reversed appears to be headed toward trial.

An Apache County judge dropped murder and other charges against Joseph Roberts with prejudice in January 2011. The judge said Roberts' trust in the system was betrayed when the county attorney's office discussed a plea deal with him without legal representation.

An appellate court found no evidence of genuine discord between Roberts and his attorney. It reversed the dismissal and sent the case back to Apache County for a trial on the merits.

Late last month, the state Supreme Court declined a petition to review that decision. Roberts did not seek reconsideration.

No court dates have been scheduled yet in Apache County.
