Deadline passes for man to appeal Ariz. conviction


PHOENIX (AP) - The deadline has passed for a man convicted of escaping from an Arizona prison to further appeal the jury's verdict and sentencing.

John McCluskey had until Thursday to challenge an appellate court ruling that upheld his conviction on state charges of escape, kidnapping and aggravated assault.

A spokeswoman for the Arizona Supreme Court said Friday that the court had no record of an appeal.

McCluskey was 1 of 3 prisoners who authorities say fled a medium-security prison near Kingman in 2010 with the help of an accomplice and went on a multi-state crime spree.

He is imprisoned in New Mexico, awaiting trial on federal charges of carjacking and murder in the deaths of an Oklahoma couple there.
