Arizona asks court to reconsider Milke ruling

PHOENIX (AP) - Arizona's attorney general is asking a federal appeals court to reconsider a ruling that could result in freedom for a death row inmate convicted of murder and sentenced to die for the killing of her 4-year-old son.

The Ninth U.S. Circuit Court of Appeals on March 14 overturned the conviction of Debra Milke.

The ruling said prosecutors failed to provide the defense with evidence about the credibility of a key witness, a detective who testified that Milke confessed to arranging her son's killing.

Attorney General Tom Horne says the ruling should be reconsidered because Milke's defense team's appeals in state courts didn't raise the issue of not getting evidence on the witness' credibility.

Horne's office filed its petition Thursday.
