BULLHEAD CITY, Ariz. (AP) - A Mohave County judge has ruled that a 31-year-old Kingman man is incompetent to stand trial in the killing of his father in 2008 and will be treated at a mental health facility.

Shawn Guerrero was sent to the Arizona State Hospital in 2009 before being ruled competent to stand trial in the shooting death of 59-year-old John Guerrero.

However, the younger Guerrero was sent to a Pima County facility in late 2011 and subsequently found incompetent to stand trial.

Superior Court Judge Lee Jantzen's recent ruling affirms that evaluation, and Guerrero is to be placed in a Mohave County facility for treatment under civil laws.

The Mohave Daily News reports that dismissal of the criminal case would allow refiling of the murder and other charges against Guerrero.
