Man shot in Detroit upset suspect given low bond

DETROIT (WJBK) -

Neighbors said he threatened them with a shotgun, then opened fire wounding two people. Now one of the victims has said he's angry the man accused of pulling the trigger is already out of jail.

"I got 13 staples," Paul said. "They had to cram a tube down my throat to drain my lungs."

Paul almost died on Friday. He was shot in the shoulder, face and throat, bird shot allegedly fired by an 84-year-old man he didn't even know. That man is Edward Simmons, a veteran, and he was out of jail before Paul was even out of the hospital.

"He was at home before I was even out of critical condition. I don't understand it," Paul said.

Wayne and Paul had hopped on their Harleys and rode over to Detroit's east side to visit their friend, Roger. When they arrived, we're told Roger was arguing with his neighbor, Simmons, and Simmons had a gun, fired and shot Roger first.

"Roger was losing consciousness on the ground," Wayne said.

Paul said when he saw Roger get shot, he was just trying to get out of the way. Then he was hit, too.

"I have no idea who he is or what the problem was, and he shot me right in the throat," Paul said.

When police and EMS arrived, Wayne said he watched as cops took Simmons into custody and pulled a lot of weapons out of his house.

"A Tommy gun with a hundred round clip, AK-47, AR-15, 30-30, a bunch of handguns," he said. "It was just like that guy was ready for war."

Simmons was arraigned on Monday and charged with ten crimes, including three charges of assault with intent to murder, pretty serious stuff, yet he only had to fork over $1,500 to bond out.

When we stopped by his home, Simmons stayed inside and declined an interview, as did his friend, and Magistrate Millicent Sherman, who set the low bond, did not return our call.

The prosecutor can ask for a higher bond at the next court date, but Paul is just asking for justice.

"An innocent person got shot, a good person, and justice needs to prevail on this one," he said.
