International attorney talks travel to Mexico

A Goodyear woman is detained in Mexico, accused of drug smuggling. But her family says the charges are trumped up. Unfortunately, there isn't the same standard of "innocent until proven guilty" in Mexico.

Carlos Suggich is in Mexico now. He is an international attorney, a border specialist with Snell and Wilmer. We asked him if it is safe to travel to Mexico after all this.

"It's a very unfortunate case, a very unfortunate series of events that happened to this family," he says. "I'm in Mexico now. I'm working out of Los Cabos office, safe as Phoenix is. I certainly advise clients to be aware of their surroundings and be more alert… I would not say don't travel to Mexico, because I think this is an exception."

We asked: What advice would you give Americans traveling to Mexico?

"My advice is make sure you understand where you are and circumstances you are in. Many times the rights and protections you are used to having in Phoenix may not be available or different in Mexico. Make sure you understand that there could be crimes punishable in Mexico that aren't punishable in the states."

We asked: If you encounter federales in Mexico and there is discussion of a bribe do you pay it or not?

"I will never advise clients, I will not pay a bribe because you are falling for it and if you've done nothing wrong not pay them. Because that only encourages and empowers the person and it could be worse."

Yanira Maldonado will appear in court again Wednesday. There will be testimony and the judge has until Friday to make a decision whether to charge her or to let her go.
