Victim shot in the head after collision, altercation

TEMPE, Ariz. -

Tempe police say a passenger in an sport utility vehicle was fatally shot following a collision at the 48th Street and Baseline Road intersection, however the incident apparently wasn't random road rage.

The incident happened not far from a Fry's grocery store Tuesday morning.

"There was obviously some type of confrontation.. words were exchanged during that altercation.. the suspect pulled out a gun.. shot the victim multiple times.. and he kinda just stood there," said Sgt. Mike Pooley.

A federal Department of Homeland Security agent driving by the scene stopped and disarmed the car's driver, detaining him until police arrived -- talk about being at the right place at the right time.

"Luckily, he was ready for this type of thing.. he was able to help us take this suspect into custody," said Pooley.

According to investigators, witnesses told them the male victim was shot in the head.  He was taken to an area hospital where he later died from his injuries.

Police say the suspect, 22-year-old Moises Gutierrez, knew the victim, 21-year-old Zachary Rodriguez. 

Investigators say that Gutierrez is dating Rodriguez's ex-girlfriend. She was in the Honda when the shooting happened. He's facing a first degree murder charge.

The investigation is ongoing.
