DETROIT (WJBK) -

Rashida Mason said it all started with an argument over a bottle she threw out her car window. The next thing she knew, her husband, Dennis, had been shot in the head.

Rashida happened to be in the car at the time. She said it was June 16. They had just finished celebrating Father's Day with the family. They left following a man her husband argued with earlier that day. They were driving down Dequindre near Six Mile when someone shot at their car killing Dennis.

"We hit the tree, and I passed out. I just heard them say, 'We got him. We got him,'" Mason said.

A makeshift memorial now sits at the spot where the 45-year-old husband, father of three and grandfather lost his life.

One month later, Detroit Police arrested a 16-year-old male they say shot and killed Dennis Mason. He was held for five days, but then released, we've learned, because the Wayne County Prosecutor's Office wanted to go after the person who supposedly told him to pull the trigger.

We're told prosecutors believe the man driving the car in front of the Masons put the 16-year-old up to it. Although witnesses identified the shooter, right now he is a free man, and the family is worried he will strike again.

In response, a spokesperson for the Wayne County Prosecutor's Office said they were presented with a warrant in July. It was reviewed and determined further investigation was needed by police. They know it is a difficult time for the family, but based on what they have now, they are not able to charge anyone at this time.

Police continue to investigate.
