New Ruling Is A Blow To California High Speed Rail

A Sacramento Judge ruled Friday California's High Speed Rail Authority failed to meet key requirements, environmental testing and coming up with the money for the project.

Prop 1A was approved by voters in 2008, requires the authority to come up with the money for the  first operable section of the rail before construction starts.

"That cost 31 billion dollars and the authority only has 6.  So they only have 20%.  They're required to have the 31," said Attorney Mike Brady.  Brady is the attorney representing King County, in central California, and two farmers who are trying to stop the rail project.

In a statement to FOX 11 the Chairman of the Rail Authority, Dan Richard said "… Our work on the project continues.  We take our commitment to proposition 1A seriously and continue to work towards developing a high-speed rail project that benefits all Californians."

It isn't clear what the consequences to Friday's ruling will be.  Brady says there are several things the judge could decide to do, "do they have to go back to the drawing board, do I issue an injunction prohibiting them from starting construction? Just what?"

The hearing to discuss the consequences of the ruling will take place in Sacramento in three weeks.
