Educator charged in APS cheating case dies of cancer

An educator charged in the Atlanta Public Schools cheating scandal has passed away. Former D.H. Stanton principal Willie Davenport lost her battle with cancer on Tuesday.

Former APS Superintendent Dr. Beverly Hall's health is also in question. She's battling breast cancer.

Defense Attorney and former prosecutor Ken Hodges says Davenport's death and Hall's cancer battle are issues the state could be forced to address. They are two of the 35 educators indicted in the APS cheating scandal.

"A prosecutor or, ultimately, a judge is always going to look at everything when they are deciding how to resolve a case, and if someone had a terminal illness that would be something I would certainly consider. It wouldn't necessarily make me want to dismiss the case," Hodges said.

Dr. Hall's physical appearance was drastically different when she turned herself in on racketeering charges back in April.

FOX 5 News has learned a member of Hall's legal team has asked the Fulton County District Attorney's Office to take the former superintendent's failing health in consideration when prosecuting her.

Hodges believes the weight of the charges is extremely stressful.

"I wouldn't imagine that her illness would make the case go away, but certainly the fact that she's terminally ill should factor into all sides in how they resolve this case," Hodges said.

Hall's attorney, Richard Dean, told FOX 5's Aungelique Proctor that a statement about Hall's health could be forthcoming.
