Boy, 12, arrested after accidentally firing gun in school restroom

A 12-year-old MacArthur Middle School student was arrested after he may have accidentally fired a 9mm gun into a toilet during school Tuesday afternoon, according to Berkeley Police.

Police believe the boy may have been looking at, or even attempting to, unload the gun when it went off.

The superintendent of Berkeley Schools, Dr. Eva Smith released a statement that said at no time did the student ever threaten anyone with the weapon.

Berkeley Police Chief Dale Gustafson believes the child had the gun in his waistband for most of the day and took it to the bathroom just before school was out.

"We don't know where he got the gun, but it was a curiosity thing," Gustafson says. "He had gone to the washroom with the weapon and the weapon discharged, which it's looking more and more like an accidental discharge."

The police chief says the bullet went into a toilet. Shortly after, the principal was notified about the gun shot.

Authorities found the gun on the boy while they were questioning him.

"The principal saw the opportunity," Gustafon explains. "The child wasn't threatening in any manner so he took the gun away from him."

When asked why he brought the gun to school, the boy responded by saying, "I don't know," according to Chief Gustafson.

The student is now at the Cook County juvenile detention center where he faces an unlawful use of a weapon charge.

There was concern from students and parents who began to find out more details throughout the day.

"When I hear about it, yeah I'm concerned. I'm concerned for the family, I'm concerned for the students," parent Rosemary Szpak told FOX 32.

Some wonder if the school should turn to metal detectors to prevent incidents like this.

"It's a shame, but they might need them," one parent said.

Police say the gun is not stolen. They're running the weapon through databases to also determine if the gun has been used in any crimes.
