Ruling could threaten Pink Pony in Brookhaven

DEKALB COUNTY, Ga. -

A longtime DeKalb County strip club has had its lawsuit against the city of Brookhaven thrown out by a judge. The ruling could determine whether or not the Pink Pony remains open.  

The litigation came after the city adopted an ordinance to ban the combination of nude dancing and alcohol in the same establishment.

Owners of the 22-year-old club say the laws they worked under while a part of DeKalb County should be grandfathered in, shielding them from the ordinance.

The Pink Pony has long said the ordinance would cripple business.  Despite the setback, club attorney Aubrey Villines says they plan to appeal.

The new ordinance was supposedly set to begin New Year's Day. However the city says it may allow the Pink Pony to operate business as usual until the appeals process works its way through the courts.
