U.S. Marshals shoot suspect wanted in connection with weapons theft

A suspect accused of taking a rifle from a Pinal County Sheriff's deputy vehicle was shot outside of a grocery store near 48th Street and Southern Monday night.

Even though it was a U.S. Marshal that shot the suspect, Phoenix Police have taken the lead on this case.  Officers say when the marshals approached the suspect, he was armed.

A U.S. Marshals task force had been watching the 24-year-old suspect for some time.  They moved in around 5 p.m. in the parking lot of the Food City store, which was full of customers.

This witness says she saw everything.

"And all of a sudden we see the car just hit this one car.. blocked this car in.. then they was beating the window in, saying get out, get out," said Lisa.  "Then when that one dude.. the Spanish dude.. stepped out of the car.. he was trying to get out.. I seen his hands out the window and that officer shot him in the car.. shot at him right there."

The suspect was a passenger in a car driven by 24-year-old Cosso Juarez.

"Passenger exited the vehicle, had a weapon on him, we're still working out the details at this point, but there was an exchange gunfire.. one of the U.S. Marshal officers fired at this particular suspect, he was struck multiple times," said Sgt. Steve Martos.

The suspect was transported to an area hospital with non-life threatening injuries.

The Pinal County Sheriff's Office says the rifle was stolen out of an unmarked patrol car.  The suspect smashed a window to get inside.

It's not clear how long the U.S. Marshals Service had been watching the suspect before they moved in Monday afternoon.

"Waited for the parking spots, then all of a sudden, bam, bam, bam! Get out! Get out! Get out! Put your hands up! And dude was trying to get out and all I know homeboy just be standing with a gun... pow pow pow.. shot him with the gun," explained Lisa.

While Lisa says she did not see a weapon on the suspect, police say otherwise.  They tell FOX 10 they found a gun at the scene. It's not clear if it's the same weapon that was stolen out of the PCSO deputy's vehicle.

Police say the suspect has an outstanding felony warrant and will be booked once he's released from the hospital.

Juarez, the man with the suspect, was arrested after he was found in possession of drugs and drug paraphernalia.
