Ex-Phoenix prep teacher gets prison in sex case

A former Brophy Prep teacher accused of molesting students learned his punishment Monday.

Dan Whitehead will go to prison after pleading guilty to one count of sex abuse and no contest to two other counts.
Whitehead was sentenced to a year in prison and 7 years probation, he's 73 years-old and has medical problems.

His attorney told the judge he'll most likely die behind bars.

Using a cane to help him walk Dan Whitehead waved before he was taken to prison.
"I've never, ever had a chance to apologize," said Dan Whitehead.
The former Brophy Prep teacher accused of sexually abusing students told his victims he was sorry.

"If I caused anybody the pain that you people are saying it's just going to make me sicker it really is," he said.

"I've been on house arrest for almost 19 months, I've had plenty of time to think about this and boy I do think about it," he said.

The victims now adults say the ex baseball coach and math teacher would give them alcohol..show them pornography before making a sexual advance.

"44 years ago I trusted a man and he ripped that away from me ripped that away from me in a single night," said victim Patrick O'Dowd.

"I try to remember what happened alcohol impeded it but now that it's here its just, ugh," said Whitehead.

"Have I thought about suicide yes but then I said that's not fair to my family," he said.

Whitehead's friends and family asked for clemency, but Judge Bruce Cohen reminded them Whitehead voluntarily plead guilty to one count of sex abuse.

"You are guilty that's not open for debate, that's not open for discussion, you plead guilty to one count and you were found guilty of two others," said Judge Bruce Cohen.

"Your legacy sir after 40 years of teaching and undoubtedly touching in a very positive way the lives of many I think that your 40 years of teaching will be remembered based on this case, not by the things you did that were positive and I believe that legacy is deserved," said Cohen.

Brophy fired Whitehead in 2011 when the allegations first came to light.

After prison, he's not allow to teach, tutor, or mentor students younger than 18 while he's on probation.
