Witnesses recognize suspected hit-and-run driver from crash scene

DETROIT (WJBK) - The 8-year-old girl who was struck by a car at an ice cream truck died from her injuries early Monday morning. Two people have been charged in the incident.

Cortney Shields, 23, has been charged with reckless driving and failing to stop at an injury accident, and 19-year-old Leonard Crosby is charged with being an accessory after the fact.

Witnesses who were at the scene on Detroit's west side after it happened tell FOX 2's Maurielle Lue they believe Shields came back to scope it out.

"He comes from around the corner here and he's walking up here in front of the house and he was talking to me about it. He asked me what about the girl? ... He felt guilty about it or something, you know, he hit her and he came back around the corner to talk about it to see if she died," believes Troy Williams.

Police believe Shields failed to stop at the ice cream truck's stop sign, which was extended with blinking red lights. Police say the impact sent Kamari Smith airborne and knocked her out of her shoes.

Authorities believe Shields and Crosby tried to cover up the alleged crime by repairing the rental car before having a friend return the car at Marks One Car Rental in Oak Park, but they apparently missed a spot.

"The grill and the bumper had some scratches and stuff on it, like the hood had some scratches on it as well," says Heather Moffat from Marks One Car Rental.

Kamari never regained consciousness after the accident or the strength to breathe on her own. Now, police are asking prosecutors to upgrade the charges.

UPDATE: Prosecutors have upgraded the charges against Shields. On Wednesday, May 28, 2014 his charges will be amended to Second Degree Murder (Life or any term of years), Reckless Driving Causing Death ( 15 years) and Failure to Stop When at Fault Causing Death (15 years). 
Meanwhile, loved ones are planning a vigil for Kamari on Wednesday.
