Time is running out for those affected by the Krispy Kreme data breach to submit a claim to receive their share of a recent settlement with the company.

By the numbers:

Individuals with documented losses as a result of the November 2024 breach are eligible for up to $3,500 per settlement class member, according to the settlement website. Claims submitted without documentation will be eligible for an estimated $75 payout.

Affected individuals who do not want to be part of the settlement and retain the right to file their own lawsuit must exclude themselves by June 6, 2026, which is also the date for anyone who wishes to file an objection. Those planning to make a claim must have their forms submitted or postmarked by June 22, 2026.

Krispy Kreme lawsuit eligibility

Approximately 161,000 people were affected by the data breach, according to the Maine Attorney General’s website. Those who are eligible for the settlement were sent a notice about the breach that warned them their personal information may have been compromised.

Anyone with questions about whether they were included can contact the Settlement Administrator at this website or by calling 877-239-1879. One year of credit monitoring will be available for any victims, regardless of whether they file a claim. However, those who do not file a claim will be ineligible for a monetary payout.

The backstory:

The settlement comes as the result of a class action lawsuit filed on behalf of the victims of the Krispy Kreme data breach that was discovered on November 29, 2024, the settlement website explained. The information accessed included a combination of names, dates of birth, Social Security numbers, and financial account access information.
