Lori Vallow Daybell: Arizona judge denies motion by 'Doomsday Mom' to dismiss case

An Arizona judge has denied a motion by Lori Vallow Daybell to dismiss her Arizona case.

On Jan. 22, we reported that Vallow Daybell, also known as the so-called "Doomsday Mom," filed a motion to dismiss her Arizona case, citing a lack of a speedy trial.

Vallow Daybell on trial in Arizona in separate case

Lori Vallow was deemed competent to stand trial in Arizona during a hearing in Phoenix on Dec. 5.

Vallow Daybell's trial in Arizona came after she was found guilty in Idaho for killing her two children, Joshua "JJ" Vallow and Tylee Ryan.

Vallow Daybell was also found guilty of her role in the death of Tammy Daybell. Tammy was the first wife of Chad Daybell, who is Vallow's current husband. As a result of the guilty finding, Vallow was sentenced to life in prison in Idaho.

The backstory:

In Arizona, Vallow Daybell is charged with conspiracy to commit murder in the death of her former husband, Charles Vallow, and attempted murder of her ex-nephew-in-law, Brandon Boudreaux.

The shootings of Charles and Brandon happened within months of each other in 2019, and in Charles' shooting, investigators identified the suspect as Vallow's late brother, Alex Cox.

According to police, the shootings of Charles and Brandon were motivated by money and a bizarre spiritual system.

AZ judge listed trial delays

What The Judge Said:

In his ruling on the matter, Judge Justin Beresky wrote that the trial has been continued several times over the objection of the defendant. In legal terms, continuance is what a court can grant to delay legal proceedings to another time.

Judge Beresky listed the times when continuance was granted due to various reasons, including time needed to review evidence and competency evaluation.

"Each continuance of the trial date was based on the extraordinary circumstances of the case, and delay was indispensable to the interests of justice," the judge wrote.

What's next:

Charles Vallow's murder trial is scheduled to begin on March 31.

While a trial has not been set in the Brandon Boudreaux case, the judge did say the trial will proceed soon after Charles' murder trial, assuming Vallow Daybell is "prepared to proceed with back-to-back trials."
